Terms of Service

Last updated: October 18, 2026 (version 2)

These Terms of Service (“Terms”) govern your access to and use of askingahuman (the “Service”), operated by dahlia47 LLC, a Colorado limited liability company (“we,” “us,” or “our”). By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

This version applies to new users from October 18, 2026. If you agreed to an earlier version, it applies to you from November 17, 2026, or from when you accept it, if sooner. Experts must accept it before taking paid sessions.

Section 15 requires most disputes to be resolved by individual arbitration with the American Arbitration Association, not in court, and waives class actions. You can opt out within 30 days.

1. What the Service is

askingahuman lets developers whose AI agents use the Service (“Requesters”) reach the real people (“Experts”) they choose, for live chat and video sessions and for free questions answered later. We provide the platform that makes these connections, measures session time and handles payments. We are not a party to the conversations and do not provide the answers, advice or services exchanged between Requesters and Experts.

AI disclosure. The other side of every request, chat and call is an AI agent run by a Requester, not a person. We label every request, chat and call so Experts always know they are dealing with an AI agent. Experts are real people, and what they provide is human work (see section 4). Neither side may pretend otherwise.

Early access. The Service is in early access and may change or be unavailable at times. Experts join by application and are reviewed before they can take requests.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. The Service is not available to anyone under 18, and we close accounts that we learn belong to a minor. You are responsible for activity under your account and for keeping your credentials and API keys secure. Tell us promptly about any unauthorized use. We may suspend or close accounts that break these Terms. You may not use the Service if you are in a country under comprehensive US sanctions or are on a US government list of prohibited or restricted parties.

3. Developer and API terms

  • Anyone 18 or older, or any business, may use the Service as a Requester. If you create an API key for an organization, you confirm that you may accept these Terms for it, and “you” in these Terms then means that organization.
  • API keys belong to your account; do not share, resell or publish them.
  • You are responsible for all usage and charges under your keys.
  • You may not use the Service to send unlawful, harassing, deceptive or infringing content to Experts, to try to identify or contact Experts off the platform, or to get around time measurement, rate limits or payment.
  • Your agent must not claim or imply that it is a person, or impersonate a real person or organization. You are responsible for everything your agent says and does through the Service, as if you had done it yourself.
  • Do not ask an Expert to do anything illegal, to share their contact details or personal information, or to give advice they are not qualified or licensed to give.
  • Your agent may record, screenshot, transcribe and keep what it receives in a session (see section 7). If it does, you are responsible for those recordings: keep them secure, use them only for the work your agent was doing, follow the privacy and recording laws that apply to you, and do not publish, sell or share an Expert’s image or voice, or use a recording to identify or contact an Expert outside the Service.
  • No likeness or biometric use. You may not use an Expert’s image, voice or likeness from the Service, or let anyone else use it, to train, fine-tune or evaluate any AI or machine-learning model; to create a synthetic voice, face, avatar or other imitation of the Expert; or to extract, store or use biometric identifiers or information (such as face geometry or voiceprints). Delete images and audio of anyone else who appears in a session as soon as your agent’s work no longer needs them. These limits survive the end of your use of the Service.
  • We may apply rate limits and revoke keys that abuse the Service.

4. Expert terms

  • Experts are independent contractors, not employees or agents of dahlia47 LLC. You decide whether, when and at what rate you are available.
  • Experts join by application, and we review each profile before it can take requests. We may decline or remove a profile at our discretion.
  • To keep quality high, we may send you test questions that look like ordinary questions. We review your answers to them, and they don’t count toward your public track record. If you list credentials (a license, degree or similar), we check them before showing them, and you must keep them accurate.
  • You are responsible for the accuracy and lawfulness of what you communicate, for your own taxes (including income tax and any VAT or sales tax on what you earn), and for any licenses your work requires. Do not give regulated professional advice you are not licensed to give.
  • Your answers and messages must be your own work. If you use an AI tool to help prepare one, say so in that answer or message. Do not present AI-generated content as your own personal judgment or experience.
  • Sessions can be recorded by the agent. The AI agent you talk with, and the developer who runs it, may record, screenshot, transcribe and keep what you share in a session: chat messages, your voice, your camera image and anything visible or audible around you. By accepting a session you agree to this. Do not share anything you would not want recorded, and turn off your camera or microphone when you don’t need them.
  • You keep 80% of what Requesters pay for your sessions; we keep 20% as our platform fee. Payouts are made through Stripe, our payment provider. To receive them, you set up a Stripe account through us. For US accounts, Stripe’s Recipient Notice applies: Stripe doesn’t provide services to you directly, and your payout relationship is with us, under these Terms. If Stripe ever moves your account to its Connected Account Agreement, that agreement also applies, between you and Stripe. You agree to give us and Stripe accurate, complete information about you and your business, and you let us share it, and your transaction information, with Stripe. Stripe verifies your identity and collects your tax and bank details under its own Privacy Policy.
  • Paid sessions and payouts are currently available only to Experts who live in the United States, and payouts are made in US dollars. If you live elsewhere, you can answer free questions and reply in those conversations, but can’t take paid sessions. Tell us right away if you move out of the United States.
  • Tax information. Stripe will ask for your tax information, such as a Form W-9. Where the law requires, we report your earnings to the IRS and send you a copy (such as Form 1099-NEC). Payouts can be paused until required tax information is provided.
  • Tax forms. You can choose to receive your tax forms electronically in your Stripe Express dashboard, where Stripe asks for your consent. If you don’t, or if you withdraw that consent, we mail them to the address on file with Stripe. Keep your email and mailing address current in the Service and in Stripe.
  • You are paid for every block (see section 5) the Requester bought when the paid time runs out, or when the Requester ends the session, leaves early or never joins. If you end the session, or leave and don’t return within 2 minutes, before the paid time is up, you are paid in full for blocks already completed and, for the block that was in progress when you left, in proportion to the time used; you aren’t paid for later blocks. If you accept a session but never join, you aren’t paid for it.
  • You appoint dahlia47 LLC as your limited agent to receive Requesters’ payments for your sessions on your behalf. A Requester’s payment to us counts as payment to you. After each paid session we transfer your share to your Stripe account; it is paid to your bank when you request a payout, once your available balance is at least USD 50. If you haven’t finished Stripe’s payout setup, your share waits for you until you do; we handle any share that stays unclaimed as the unclaimed-property laws that apply require. If you delete your account, we send everything you’re owed and pay out your whole balance, whatever its size.
  • If a charge is refunded, the matching part of your share is taken back from your Stripe balance, in proportion to the refund. If a Requester disputes a charge, we hold or take back that block’s share while the dispute is open. If we lose the dispute, that share is not owed; otherwise we send it again. If your Stripe balance can’t cover an amount taken back, we may deduct it from your future earnings, and you agree to repay what’s still owed within 30 days of our request. If we remove your profile or close your account, we still pay what you’ve earned, less any amounts taken back under this section.

5. Prices, holds and payments

Every request names the Expert the Requester chose. Live sessions are sold in blocks: an hour of chat or 30 minutes of video, at the price each Expert sets for that block, which the Requester sees before a session starts. The Requester may extend a session by one block at a time, up to 4 hours of chat or 60 minutes of video, and no single session, extensions included, costs more than $200. The first block of every session is charged at least $20 (the session minimum), even if the Expert’s block price is lower; extensions are charged at the block price. There are no other charges: our platform fee comes out of the Expert’s share, not on top of the price.

When a session is requested, we place a hold on the Requester’s card for the first block (at least the session minimum). Each extension places a hold for one more block. A chat request may wait up to 24 hours for the Expert to accept. If the request is declined, withdrawn or expires, every hold is released.

Once the Expert accepts, each block bought is charged in full, including when the Requester ends the session, leaves early or never joins. The session ends when the paid time runs out. There are two exceptions:

  • If the Expert ends the session, or leaves and doesn’t return within 2 minutes, before the paid time is up, blocks already completed stay charged, the block that was in progress when they left is charged only for the time used (nothing if that comes to less than USD 0.50), and later blocks aren’t charged.
  • If the Expert accepts but never joins, nothing is charged.

Holds, or the part of a hold, for time that isn’t charged are released, and prepaid credit reserved for it goes back to the API key. Questions sent to an Expert who takes free questions are free.

A Requester’s agent may also pay with x402 or MPP (USDC or a card shared through Stripe). Such a payment becomes prepaid credit on its API key, which pays for sessions instead of a card hold. A key can load at most USD 2,000 of prepaid credit per day (UTC). Prepaid credit is not cash, does not expire, and can only be used for sessions. While a key is suspended, its credit can’t be used. If we close a key for breaking these Terms, unused credit is forfeited except where the law requires otherwise; if we stop offering sessions, we refund unused credit to the original payment method where we can.

Card payments, prepaid credit and Expert payouts are processed by Stripe; its own terms also apply. After each card charge, Stripe emails a receipt for us to the card’s billing email or, if there is none, to the email given for the API key. Every session’s API response also includes a signed receipt; for prepaid credit, that is the only receipt.

Each session is provided by the Expert. We collect payment as the Expert’s limited payment-collection agent. The Requester’s payment to us counts as payment to the Expert: once the Requester has paid us, they owe the Expert nothing more for that session.

All sales are final: we do not give refunds, for any session or to anyone, except where the law requires it. If a charge is disputed, we suspend the API key until we have reviewed it. See our Refund Policy.

6. Acceptable use

Do not misuse the Service, including by breaking any law or third-party right, sending malware, trying to gain unauthorized access, scraping or reverse engineering the Service, harassing or abusing other users, or using the Service to create or request illegal, exploitative or harmful content. We may remove content and suspend accounts that break these rules.

7. Content and live sessions

Your content. Questions, answers, messages, profiles and anything else you submit (“Content”) remain yours. You give us a worldwide, non-exclusive, royalty-free license to host, store, transmit and display your Content only as needed to run the Service. Answers an Expert gives are provided to the Requester who asked, who may use them for their own purposes. You promise that you have the rights to your Content and that it does not break any law or anyone’s rights.

Responsibility for Content. Content comes from users, not from us. We do not review Content before it is sent, do not endorse it, and are not responsible for it. We may remove Content and suspend accounts that break these Terms. To report Content, email support@askingahuman.com with the subject “Report”, or use Report in the Expert dashboard or app.

Removal requests. If Content on the Service shows you, including an intimate image shared without your consent, or uses your personal information, email support@askingahuman.com with the subject “Removal request”, where the Content is, and enough detail for us to find it and confirm the request is genuine. We remove non-consensual intimate images within 48 hours of a valid request and make reasonable efforts to remove copies we host. We do not store live sessions, so we cannot remove copies an agent’s developer kept; we will tell you which developer received the session and act against their account where it breaks these Terms.

Not professional advice. Content from Experts is general information and opinion. It is not legal, medical, financial, tax or other professional advice, and no professional relationship is created between you and an Expert or us.

Live sessions and recording. Live chat, audio and video are delivered in real time through our real-time provider and are not recorded or stored by us. The other side of every session is an AI agent run by a developer, and the agent and its developer may record, take screenshots of, transcribe and keep the session’s chat, audio and video and use them only for the work their agent was doing, as section 3 sets out (which also bans using an Expert’s image or voice to train models, imitate them or extract biometrics). We do not control what agents or developers do with what they receive and are not responsible for it. Free questions and answers are delivered to the developer whose agent asked, who may keep them too. Experts may save a session’s chat for their own records but must not publish it.

Copyright complaints. Our designated copyright agent is Copyright Agent, dahlia47 LLC, 1500 N Grant St, Ste N, Denver, CO 80203, (720) 227-4359, support@askingahuman.com (US Copyright Office registration DMCA-1083430). If you believe Content infringes your copyright, send the agent a notice with: your contact details; the work you say is infringed; where the Content is on the Service; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. If your Content was removed and you believe that was a mistake, you can send a counter-notice with the details required by 17 U.S.C. § 512(g). We close the accounts of repeat infringers.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that what Experts provide is accurate, complete or fit for any purpose. You rely on information exchanged through the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, dahlia47 LLC and its affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the Service is limited to the greater of what you paid us in the three months before the claim or USD 100. Nothing in these Terms limits amounts we owe you for your sessions under section 4, or liability for fraud, gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless dahlia47 LLC from claims arising from your use of the Service, your content, or your breach of these Terms, any law or any third-party right.

11. Ending your use

You can stop using the Service and delete your account at any time. We may suspend or close access for breaches of these Terms or to protect the Service or its users. Terms that by their nature should survive termination will survive.

12. Changes

We may change these Terms. We post the new version here with a new date. If a change materially reduces your rights or adds to your obligations, we tell you at least 30 days before it takes effect: by email if we have an email address for you, and in the Service (including in API responses for API keys). We may make a change sooner if the law requires it or if it is needed to stop fraud or abuse. Other changes take effect when we post them. If you don’t agree to a change, stop using the Service and close your account or delete your API keys before it takes effect. If you keep using the Service after that, you accept the new Terms. A change doesn’t apply to a dispute that arose before it took effect.

13. Electronic communications

You agree to receive notices, receipts and other communications from us electronically, by email or in the Service, and that they satisfy any requirement that they be in writing.

14. Governing law

These Terms are governed by the laws of the State of Colorado and applicable US federal law, including the Federal Arbitration Act, without regard to conflict-of-laws rules.

15. Disputes and arbitration

Talk to us first. Before starting a claim, email support@askingahuman.com with the subject “Dispute” and a description of the problem. If we cannot resolve it within 30 days, either of us may start arbitration.

Arbitration. Any dispute, claim or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules when the claim is brought by or against an individual using the Service for personal purposes, and otherwise under its Commercial Arbitration Rules, and judgment on the award may be entered in any court having jurisdiction. The AAA’s Mass Arbitration Supplementary Rules apply where they are relevant. There will be one arbitrator. Hearings may be held by video or phone; any in-person hearing for an individual will be in the county where they live, and otherwise in Denver, Colorado. The AAA rules are at adr.org.

Costs. Fees are paid as the AAA rules provide, with one exception. For a claim brought by or against an individual (including an Expert), you pay no more than the AAA’s consumer filing fee, or what it would cost you to file in court if that is less, and we pay all other AAA fees and the arbitrator’s pay. Each side pays its own lawyers unless the law or the arbitrator says otherwise.

Exceptions. Either of us may bring an individual claim in small-claims court instead, and either of us may ask a court for an injunction to stop misuse of the Service or infringement of intellectual property.

No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of different people. If this waiver is found unenforceable for a claim, that claim must be heard in the state or federal courts in Denver, Colorado, and not in arbitration.

Opting out. You can opt out of this section within 30 days after you first accept these Terms by emailing support@askingahuman.com with the subject “Arbitration opt-out” from the email address on your account. If you opt out, or if this section does not apply, disputes will be heard in the state or federal courts in Denver, Colorado.

Where the law protects you. If you are a consumer living in a country or state whose law does not allow you to agree to arbitration or to a foreign court in advance (for example, in the European Union or the United Kingdom), this section does not take away your right to bring a claim in your local courts or under your local law.

16. General

These Terms, together with the policies they link to, are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition or sale of assets. We are not responsible for delays or failures caused by events outside our reasonable control. These Terms are written in English. If we or anyone else provide a translation (including in the app), it is only for convenience, and the English version controls if they differ.
